BLACKS LEGEND terms and conditions (last update : 18/03/2024)

These terms and conditions regulate sales on the BLACKS LEGEND website ( published by Vintage Spirit Company, a limited liability company with variable capital of €154,000 whose registered office is at Le Tomas - La Haute-Plaine, 05260 Chabottes in France, registered with the Gap Trade and Companies Register under number 53 222 746 900 014. VAT number FR 48 532 227 469.
Internet users can access the General Terms and Conditions page from the website. These general terms and conditions of sale can be consulted without restriction, and the Internet user may print them out. If necessary, Vintage Spirit Company will send you a copy of this document on request by post or e-mail.
The Vintage Spirit Company may make changes at any time without notice to users, which will apply as soon as the T&Cs are published on the website.

These conditions apply to the exclusion of all other conditions. 

1/ Product features

The products offered by the Vintage Spirit Company are products designed and developed for the BLACKS LEGEND brand. The Vintage Spirit Company holds the official worldwide license for the manufacture and resale of BLACKS LEGEND brand textile and accessory products.
- All product characteristics displayed on the site are available on the product sheet. If necessary, the customer can contact the company for advice and information on the brand's products.
- The photographs and visual representations of the Vintage Spirit Company's products illustrate as faithfully as possible the products sent. Vintage Spirit Company cannot be held responsible for any color deviations between the digital visual and the product itself, as the images are processed on different computer monitors and a difference may be noted depending on the monitors used by the users.
- Vintage Spirit Company reserves the right to change product details, quantities, photographs and prices displayed on the website.

2/ Availability and execution

Shipments are generally processed and prepared within 24 to 48 working hours (Monday to Friday) from the time the order is received. The products offered on the site are available while stocks last, unless otherwise indicated. In the event of stock shortage or delay, the customer will be informed of the delivery date within 72 working hours of receipt of the order, by e-mail, telephone or post. In this case, the customer may cancel or modify the order.

  • "Sold out" : unfortunately means that the item is permanently out of stock and cannot be delivered. Contact our Customer Service either via our contact form, or by telephone on 04 92 24 94 05 (or +33 492 24 94 05 from abroad).
  • You then have two options: either make a second choice to replace the out-of-stock item, or don't want a replacement. In the latter case, you have a credit corresponding to the value of the sold-out items to deduct from your next order, or you can simply ask us for a refund.

- The ordered products will only be reserved once the payment has been received and validated by the payment systems or the accounting department, in the case of payment by bank transfer.
- The Vintage Spirit Company cannot be held responsible for any discrepancies between the virtual stock displayed on its website and the company's actual stock.

3/ Rates and special offers

» Product prices :

- For destinations not subject to VAT in the European Union zone, the price excluding VAT will be confirmed during the order process, once the destination has been indicated. The addressee will be responsible for any applicable local VAT or customs duties that may be levied by the local authorities.
- The price applicable to the product ordered is that shown on this site on the day the order is placed for the product(s) in question.
- Our prices include VAT and are calculated ex-warehouse. We use TNT Express France, TNT International or Chronopost for shipping. We cover part of the postage and packaging costs, and ask our customers to pay a flat-rate contribution to these costs. This contribution varies according to the delivery method, the service provider and the country of delivery.
- The Vintage Spirit Company reserves the right to change prices without notice and may be subject to variations in conditions imposed by our suppliers, beyond the company's control.
- It is understood that the company retains full and exclusive ownership of the products sold until their price has been paid in full.

» Special offers :

- Any special offer recommended to the customer by post or e-mail is applicable to the Internet order within the limits of the conditions described in the offer. To benefit from these discounts and gifts, the SPECIAL DISCOUNT CODE must be indicated in the “Enter your discount voucher” field when ordering online. If this code is not indicated, the application of this offer remains at the discretion of Vintage Spirit Company.
- Discounts and gifts linked to an offer code will be automatically applied to the processing of your order under the conditions indicated above.
- Special offers are not cumulative and cannot be applied to products whose prices are already reduced and presented as special prices or “Promotions”.

4/ Orders

- Customers wishing to place an order on our website can do so by selecting one or more products, which will be automatically added to their shopping cart. Customers have the option of logging in with a user account, either created beforehand or at the time of ordering. To validate the customer file, it is imperative to fill in all the fields as accurately as possible.
- Customers can also order without creating a customer account, by entering their contact details when validating their order.
- The company reserves the right to transform customer information into a customer account, should the company need to contact the customer. In this case, a login password will be automatically generated and sent to the user's e-mail address.
- Minors do not have the capacity to enter into contracts, and any collection of data must be subject to the agreement of the parental authority, which may object to their storage and/or transmission to third parties.

» Order process

- Customers can order by adding one or more products to their virtual basket. Once the products have been added, the customer can either continue shopping or place the order. For this next step, the customer is invited to log in if they have a customer account, or to register their personal information when creating their user account.
- The customer will ensure that the products selected are those desired, in shape, color and size.
- The buyer will then be able to select the method of payment. The website offers several payment methods: credit card, PayPal or bank transfer. Please note that payment by bank transfer extends the processing time.

» Order preparation

- Once the customer has placed an order on the website, Vintage Spirit Company will endeavour to process the order as quickly as possible.
- Orders are prepared from Monday to Friday, in the morning, except on public holidays. All orders placed after 10:00 am will be processed the following day. If the order is validated on Friday after 08:00, it will be prepared on the following Monday (excluding public holidays).
- In the event of a problem during order preparation, Vintage Spirit Company will contact the purchaser as soon as possible to inform him/her of the problem (stock error, shortage, etc.).

5/ Payment terms and conditions

- BLACKS LEGEND is equipped with the SSL (Secure Socket Layer) payment security system, which means that your credit card number and your order are encrypted and never circulate unencrypted on the network.
- All orders placed on the website are payable at the time of ordering.
- Online credit card payment is handled by Stripe. Our payment system uses the 3D Secure system to validate your payment. This system involves entering a code sent to the telephone number you have provided to your bank. In the event of an error, the order cannot be validated. Vintage Spirit Company cannot be held responsible for any error linked to the blocking of payment by the buyer's bank or Vintage Spirit Company's bank. To validate the payment, the customer must enter the 16 numbers of your card as well as its expiry date and the cryptogram located on the back of the payment card. Direct payment by credit card guarantees rapid processing of your order.
- Thanks to the technology we use, and the fact that there is no printout of the credit card number, we can assure you that it is safer to pay with your credit card on SSL-enabled sites than in most local shops. The entire payment process between the purchaser and Vintage Spirit Company is fully encrypted and protected.
- If a customer enters a false or incomplete credit card number, his/her order will be automatically cancelled.
- Order information and credit card numbers do not circulate unencrypted on the Internet.

  • The credit card number is not printed on any paper, invoice, receipt or other listing.
  • The merchant has no knowledge of the card numbers.
  • Card numbers are never stored after they have been transmitted to the merchant's bank.

Thus, no one has computerized or printed access to buyers' credit card details.

6/ Pay in instalments with Alma

Payment by instalments/deferred payment is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Alma is a tele-payment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
Termination. Any termination of the General Terms and Conditions binding the Vendor and the customer shall result in the termination of the General Terms and Conditions between Alma and the customer.

» Purchase amounts 

Only purchases between €150 and €2,000 are eligible for payment in 2, 3 or 4 instalments with Alma.

» Fees 

There are no additional charges for paying in 2, 3 or 4 instalments.

7/ Order modification

- The customer has the possibility to modify his order as long as it is not in preparation or shipping status. To modify an order, the customer must inform customer service by email, or by using the form on the contact page. It is imperative to specify the name and number of the order, as well as the part concerned by the modification.
- Vintage Spirit Company reserves the right not to take into account the modification in case of lack of stock. In this case, we will refund your order or offer you a credit note for the amount of your order, to be used only on the website.

8/ Delivery and risk transfer

» Delivery

- Products are delivered to the address stipulated by the customer. Vintage Spirit Company cannot be held responsible if the customer enters the wrong delivery address. The customer will be responsible for all costs associated with a new address.
- The shipping costs and delivery times applied to orders placed on the website are directly linked to the geographical zone to which the destination address selected by the customer belongs, for delivery.
- Vintage Spirit Company may reimburse an order considered lost by the carrier. The amount of the refund may not exceed a carrier's excess of €150 including VAT.
- If a customer places an order on our site on a Friday, the order will be dispatched on the following Monday. No delivery will be made on Saturdays, unless explicitly requested by the customer and only via the Chronopost carrier. The Vintage Spirit Company may then ask the customer to contribute to any additional delivery costs incurred.
- The customer can choose between several service providers to ensure the delivery of his order. Only the customer can choose the service provider. Deliveries in mainland France are handled by TNT Express 24 or Chronopost Relais 13. Both services deliver between 8am and 1pm. By choosing one of the two carriers, the customer undertakes to receive the order at the address between 8am and 1pm against signature. In the event of absence, the carrier will leave a calling card at the address indicated or drop off the parcel at a relay point. Any additional shipping costs, in the event of representation of the parcel, will be fully charged to the customer.
- If the customer chooses delivery to a “point relais”, the customer will have 7 days to collect the parcel from the delivery address. The choice of delivery method and location is made at the time the order is placed. If the customer does not collect the parcel within this period, it will be returned to us. Vintage Spirit Company reserves the right to charge for re-delivery if the customer requests this service.

» Risk transfer

- The transfer of ownership of the products to the customer occurs on the date of full payment of the price. The transfer of risk occurs when the products are handed over to the customer.
- In the event of damage or shortage, the customer must refuse the parcel and indicate the reasons for refusal on the delivery note, or failing that on the invoice (the simple mention “with reservations” is insufficient). You must then send a reasoned protest to the carrier, by registered letter, within three days, not including public holidays, and inform Vintage Spirit Company of this action. The same procedure can be followed if the damage was not discovered until the package was opened.
- In the event of non-conformity of the product(s) delivered, the merchant undertakes to refund or exchange the product(s) to the customer as soon as possible.


9/ Withdrawal right

CIn accordance with article L.121-18 of the French Consumer Code, the consumer has a period of fourteen (14) clear days from delivery of the Product to exercise his or her right of withdrawal without having to justify his or her reasons or pay any penalties, with the exception, where applicable, of the cost of returning the Product.

» Retraction notification

To exercise the right of withdrawal, the customer must inform Vintage Spirit Company of his or her intention to withdraw before the expiry of the aforementioned 14-day period, using the withdrawal form provided or by any other unambiguous statement to be sent :

» Procedure for returning products after withdrawal

Upon receipt of the Customer's notification of withdrawal, Blacks Legend Customer Service will send the Customer, by e-mail, the procedure for returning the Products. The Products must be returned by the Customer without undue delay and, in any event, within fourteen (14) calendar days from the date of notification of his decision to withdraw, to the following address : Vintage Spirit Company - Retour ESHOP - 111 Rue Coste Belle - ZI la Grande Île Sud - 05230 Chorges - FRANCE
They must be sent, if possible, in their original packaging (or at least in packaging that protects the Products in conditions comparable to the original packaging), together with a copy of the returns procedure sent by Customer Services. This procedure will include the order number and the return number, with the reason for return to be completed by the Customer.
The Customer may be held liable in the event of depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Products (e.g. for a fastener). Underwear (briefs and socks) cannot be the subject of a right of retraction in application of article L.221-28 paragraph 5 of the French Consumer Code in the event that their packaging has been unsealed and the Products tried on.
Products are returned at the Customer's expense and risk (except when the return is justified by a hidden defect or non-conformity of the Products delivered in application of article 9 below). If the Products are not received at the warehouse, Vintage Spirit Company will not be able to process the returns. In any case, Vintage Spirit Company cannot be held responsible for the loss of a package returned by the Customer.
In case of Products returned incomplete, damaged, deteriorated or soiled by the Customer, Vintage Spirit Company reserves the right to take advantage of articles 1219 and 1220 of the French Civil Code on the exception of non-performance as a preventive measure or a posteriori.

» Refund of products after withdrawal

Upon receipt by Vintage Spirit Company of the Product returned by the Customer, the corresponding refund will be made, including delivery costs, by crediting the bank account linked to the payment made at the time of purchase, within fourteen (14) calendar days of the date of notification of the Customer's decision to withdraw. Reimbursement will be made by the same means of payment used for the order.
It is specified that in the absence of receipt of the Product before the expiry of the period of fourteen (14) calendar days following the date of notification of the Customer's decision to withdraw, reimbursement of the Product returned by the Customer, including delivery costs, may be deferred until the earlier of the following two dates:
- the date on which the Product is received by Vintage Spirit Company,
- or the date on which the Customer provides proof of shipment of the Product.
In any case, no credit note, electronic or otherwise, can be issued by Vintage Spirit Company in this respect.


10/ Legal guarantees

The customer may make a claim under the legal warranty of conformity provided for in articles L.217-3 et seq. of the French Consumer Code, or under the warranty for defects in the Product sold within the meaning of articles 1641 et seq. of the French Civil Code, to the guarantor seller, i.e. Vintage Spirit Company. The latter is liable for defects in conformity of the Product with the contract under the terms of article L.217-3 et seq. of the French Consumer Code, and for hidden defects in the Product sold under the terms of article 1641 et seq. of the French Civil Code.

When acting under the legal warranty of conformity, the customer:
- has a period of two years from the date of delivery of the Product in which to act- may choose between repair or replacement of the Product, subject to the cost conditions stipulated in article L.217-12 of the French Consumer Code
- is exempted from proving the existence of the lack of conformity of the Product during the twenty-four months following delivery of the Product.

The legal warranty of conformity applies independently of any commercial warranty.

The Customer may decide to invoke the warranty against hidden defects in the Product sold, as defined in article 1641 of the French Civil Code. In this case, the Customer may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code.

» 10.1 Legal warranty of conformity

If the Product ordered by the Customer presents a defect of conformity existing at the time of delivery, Vintage Spirit Company undertakes to replace the Product, within the limit of available stocks. If replacement is not possible, Vintage Spirit Company will refund the price after the Product has been returned by the Customer. The detailed content of the legal warranty of conformity is described in articles L217-1 et seq. of the French Consumer Code. The main provisions of this legal guarantee are outlined below. Please note that you may contact us if you have any questions or require clarification concerning the application of this legal guarantee:
Article L217-3 du Code de la consommation
« Le vendeur délivre un bien conforme au contrat ainsi qu'aux critères énoncés à l'article L. 217-5. Il répond des défauts de conformité existant au moment de la délivrance du bien au sens de l'article L. 216-1, qui apparaissent dans un délai de deux ans à compter de celle-ci (…) ».

Article L217-4 du Code de la consommation
« Le bien est conforme au contrat s'il répond notamment, le cas échéant, aux critères suivants :
1° Il correspond à la description, au type, à la quantité et à la qualité, notamment en ce qui concerne la fonctionnalité, la compatibilité, l'interopérabilité, ou toute autre caractéristique prévue au contrat ;
2° Il est propre à tout usage spécial recherché par le consommateur, porté à la connaissance du vendeur au plus tard au moment de la conclusion du contrat et que ce dernier a accepté ;
3° Il est délivré avec tous les accessoires et les instructions d'installation, devant être fournis conformément au contrat ;
4° Il est mis à jour conformément au contrat ».

Article L217-5 du Code de la consommation
« I.- En plus des critères de conformité au contrat, le bien est conforme s'il répond aux critères suivants :
1° Il est propre à l'usage habituellement attendu d'un bien de même type, compte tenu, s'il y a lieu, de toute disposition du droit de l'Union européenne et du droit national ainsi que de toutes les normes techniques ou, en l'absence de telles normes techniques, des codes de conduite spécifiques applicables au secteur concerné ;
2° Le cas échéant, il possède les qualités que le vendeur a présentées au consommateur sous forme d'échantillon ou de modèle, avant la conclusion du contrat ;
3° Le cas échéant, les éléments numériques qu'il comporte sont fournis selon la version la plus récente qui est disponible au moment de la conclusion du contrat, sauf si les parties en conviennent autrement ;
4° Le cas échéant, il est délivré avec tous les accessoires, y compris l'emballage, et les instructions d'installation que le consommateur peut légitimement attendre ;
5° Le cas échéant, il est fourni avec les mises à jour que le consommateur peut légitimement attendre, conformément aux dispositions de l'article L. 217-19 ;
6° Il correspond à la quantité, à la qualité et aux autres caractéristiques, y compris en termes de durabilité, de fonctionnalité, de compatibilité et de sécurité, que le consommateur peut légitimement attendre pour des biens de même type, eu égard à la nature du bien ainsi qu'aux déclarations publiques faites par le vendeur, par toute personne en amont dans la chaîne de transactions, ou par une personne agissant pour leur compte, y compris dans la publicité ou sur l'étiquetage.
II.- Toutefois, le vendeur n'est pas tenu par toutes déclarations publiques mentionnées à l'alinéa qui précède s'il démontre :
1° Qu'il ne les connaissait pas et n'était légitimement pas en mesure de les connaître ;
2° Qu'au moment de la conclusion du contrat, les déclarations publiques avaient été rectifiées dans des conditions comparables aux déclarations initiales ; ou
3° Que les déclarations publiques n'ont pas pu avoir d'influence sur la décision d'achat.
III.- Le consommateur ne peut contester la conformité en invoquant un défaut concernant une ou plusieurs caractéristiques particulières du bien, dont il a été spécifiquement informé qu'elles s'écartaient des critères de conformité énoncés au présent article, écart auquel il a expressément et séparément consenti lors de la conclusion du contrat ».

Article L217-7 du Code de la consommation
« Les défauts de conformité qui apparaissent dans un délai de vingt-quatre mois à compter de la délivrance du bien, y compris du bien comportant des éléments numériques, sont, sauf preuve contraire, présumés exister au moment de la délivrance, à moins que cette présomption ne soit incompatible avec la nature du bien ou du défaut invoqué.
Pour les biens d'occasion, ce délai est fixé à douze mois.
Lorsque le contrat de vente d'un bien comportant des éléments numériques prévoit la fourniture continue d'un contenu numérique ou d'un service numérique, sont présumés exister au moment de la délivrance du bien les défauts de conformité qui apparaissent :
1° Durant un délai de deux ans à compter de la délivrance du bien, lorsque le contrat prévoit cette fourniture pendant une durée inférieure ou égale à deux ans ou lorsque le contrat ne détermine pas la durée de fourniture ;
2° Durant la période durant laquelle le contenu numérique ou le service numérique est fourni en vertu du contrat, lorsque celui-ci prévoit cette fourniture pendant une durée supérieure à deux ans ».

Article L217-8 du Code de la consommation
« En cas de défaut de conformité, le consommateur a droit à la mise en conformité du bien par réparation ou remplacement ou, à défaut, à la réduction du prix ou à la résolution du contrat, dans les conditions énoncées à la présente sous-section.
Le consommateur a, par ailleurs, le droit de suspendre le paiement de tout ou partie du prix ou la remise de l'avantage prévu au contrat jusqu'à ce que le vendeur ait satisfait aux obligations qui lui incombent au titre du présent chapitre, dans les conditions des articles 1219 et 1220 du code civil.
Les dispositions du présent chapitre sont sans préjudice de l'allocation de dommages et intérêts ».

« Article L217-12 du Code de la consommation
Le vendeur peut ne pas procéder selon le choix opéré par le consommateur si la mise en conformité sollicitée est impossible ou entraîne des coûts disproportionnés au regard notamment :
1° De la valeur qu'aurait le bien en l'absence de défaut de conformité ;
2° De l'importance du défaut de conformité ; et
3° De la possibilité éventuelle d'opter pour l'autre choix sans inconvénient majeur pour le consommateur.
Le vendeur peut refuser la mise en conformité du bien si celle-ci est impossible ou entraîne des coûts disproportionnés notamment au regard des 1° et 2°.
Lorsque ces conditions ne sont pas respectées, le consommateur peut, après mise en demeure, poursuivre l'exécution forcée en nature de la solution initialement sollicitée, conformément aux articles 1221 et suivants du code civil.
Tout refus par le vendeur de procéder selon le choix du consommateur ou de mettre le bien en conformité, est motivé par écrit ou sur support durable ».

Article L217-13 du Code de la consommation
« Tout bien réparé dans le cadre de la garantie légale de conformité bénéficie d'une extension de cette garantie de six mois.
Dès lors que le consommateur fait le choix de la réparation mais que celle-ci n'est pas mise en œuvre par le vendeur, la mise en conformité par le remplacement du bien fait courir, au bénéfice du consommateur, un nouveau délai de garantie légale de conformité attaché au bien remplacé. Cette disposition s'applique à compter du jour où le bien de remplacement est délivré au consommateur ».

Article L217-14 du Code de la consommation
« Le consommateur a droit à une réduction du prix du bien ou à la résolution du contrat dans les cas suivants :
1° Lorsque le professionnel refuse toute mise en conformité ;
2° Lorsque la mise en conformité intervient au-delà d'un délai de trente jours suivant la demande du consommateur ou si elle lui occasionne un inconvénient majeur ;
3° Si le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte l'installation du bien réparé ou de remplacement ou les frais y afférents ;
4° Lorsque la non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.
Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu'il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n'est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.
Le consommateur n'a pas droit à la résolution de la vente si le défaut de conformité est mineur, ce qu'il incombe au vendeur de démontrer. Le présent alinéa n'est pas applicable aux contrats dans lesquels le consommateur ne procède pas au paiement d'un prix ».

Article L217-17 du Code de la consommation
« Le remboursement au consommateur des sommes dues par le vendeur au titre de la présente sous-section est effectué dès réception du bien ou de la preuve de son renvoi par le consommateur et au plus tard dans les quatorze jours suivants.
Le vendeur rembourse ces sommes en recourant au même moyen de paiement que celui utilisé par le consommateur lors de la conclusion du contrat, sauf accord exprès de ce dernier et en tout état de cause sans frais supplémentaire ».

Article L217-28 du Code de la consommation
« Lorsque le consommateur demande au garant, pendant le cours de la garantie légale ou de la garantie commerciale qui lui a été consentie lors de l'acquisition ou de la réparation d'un bien, une remise en état couverte par cette garantie, toute période d'immobilisation suspend la garantie qui restait à courir jusqu'à la délivrance du bien remis en état.
Cette période court à compter de la demande d'intervention du consommateur ou de la mise à disposition pour réparation ou remplacement du bien en cause, si ce point de départ s'avère plus favorable au consommateur.
Le délai de garantie est également suspendu lorsque le consommateur et le garant entrent en négociation en vue d'un règlement à l'amiable ».

Article L217-30 du Code de la consommation
« Les dispositions du présent chapitre ne privent pas le consommateur du droit d'exercer l'action résultant de la garantie des vices cachés telle qu'elle résulte des articles 1641 à 1649 du code civil ou toute autre action de nature contractuelle ou extracontractuelle qui lui est reconnue par la loi ».

» 10.2 Warranty against hidden defects

In the event of hidden defects, Vintage Spirit Company undertakes to reimburse the full price of the Product, after return of the Product by the Customer, or the price arbitrated by an expert, if the Customer chooses to keep the Product. The main provisions of this legal warranty are set out below. Please contact us if you have any questions or require clarification concerning the application of this warranty:
Article 1641 du Code civil :
Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus.

Article 1642 du Code civil :
Le vendeur n'est pas tenu des vices apparents et dont l'acheteur a pu se convaincre lui-même.

Article 1643 du Code civil :
Il est tenu des vices cachés, quand même il ne les aurait pas connus, à moins que, dans ce cas, il n'ait stipulé qu'il ne sera obligé à aucune garantie.

Article 1644 du Code civil :
Dans le cas des articles 1641 et 1643, l'acheteur a le choix de rendre la chose et de se faire restituer le prix, ou de garder la chose et de se faire rendre une partie du prix.

Article 1645 du Code civil :
Si le vendeur connaissait les vices de la chose, il est tenu, outre la restitution du prix qu'il en a reçu, de tous les dommages et intérêts envers l'acheteur.

Article 1646 du Code civil :
Si le vendeur ignorait les vices de la chose, il ne sera tenu qu'à la restitution du prix, et à rembourser à l'acquéreur les frais occasionnés par la vente.

Article 1647 du Code civil :
Si la chose qui avait des vices a péri par suite de sa mauvaise qualité, la perte est pour le vendeur, qui sera tenu envers l'acheteur à la restitution du prix et aux autres dédommagements expliqués dans les deux articles précédents. Mais la perte arrivée par cas fortuit sera pour le compte de l'acheteur.

Article 1648 du Code civil :
L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice.

» 10.3 Methods of implementation

In order to take advantage of the warranty applicable under the conditions mentioned above, the Customer must send an e-mail to Customer Service at, describing precisely the lack of conformity and/or the hidden defect in the Product. Alternatively, the Customer may contact Customer Service on +33 (0)4 92 24 94 05. Upon receipt, the Customer will be informed whether or not the warranty claim has been accepted, and if so, the terms and conditions of the warranty claim, in accordance with the above-mentioned conditions.


11/ "Satisfied or your money back” guarantee

In addition to the right of withdrawal (described in article 9 of these general terms and conditions of sale) and the legal guarantees described in article 10, Vintage Spirit Company offers its customers a “Satisfied or your money back” commercial guarantee and undertakes to reimburse, under the conditions of this article 11 of the General Terms and Conditions of Sale, the full price of the Products purchased by the Customer if the latter is not satisfied.

If you are not completely satisfied with an item or if the size does not suit you, simply return it to us within thirty days of receipt, and contact our customer service department beforehand at Return shipping costs for the product(s) concerned are at the customer's expense.
  • If the article does not give satisfaction, it must be returned to us new and unwashed, in its original packaging and with its labels.
  • We advise you to return the item by registered parcel post (at the rate corresponding to the value of the parcel).
  • If the product is returned washed, without its labels or original packaging, we will be entitled to refuse the exchange or refund of the product(s).
  • Due to the impossibility of resale, “personalized” products (number and/or name on the back of a garment, iron-on badges, etc.) cannot be returned or exchanged.
Any order returned by the customer under this “Satisfied or your money back” commercial guarantee will be reimbursed within fifteen days of receipt of the product in the company.

For any item purchased and paid for online and then returned, the following terms and conditions apply:
  • If the package has been returned unopened: refund within 15 days. Return shipping costs are at the customer's expense.
  • If the product is returned simply because you are not satisfied with it: refund within 15 days. Return costs are at the customer's expense.
  • If the product is returned for a reason for which BLACKS LEGEND is responsible: refund or exchange of the product within 15 days, with any shipping and return costs paid by the company.
  • In case of return or cancellation, a credit note will be issued.
Requests for reimbursement of orders paid for with a gift card can only be made in the form of a credit note to be redeemed on our website.

13/ Liability

Vintage Spirit Company shall not be held liable for any inconvenience or damage inherent in the use of the Internet network, including but not limited to disruption of service, external intrusion or the presence of computer viruses. In no event shall BLACKS LEGEND or Vintage Spirit Company be liable for any indirect, incidental, special or consequential damages, including but not limited to loss of business, loss of profits or loss of opportunity resulting from the purchase of BLACKS LEGEND Products on the Site.
Nevertheless, Vintage Spirit Company remains liable for any lack of conformity of the Products sold on the Website and for any hidden defects in accordance with the provisions of article 10 above.

In general, Vintage Spirit Company shall not be held liable for any failure to meet its contractual obligations in the event that such failure is the result of force majeure, including, but not limited to: total or partial disruption or strike, in particular of postal services, means of transport and/or telecommunications, fire, flood, natural disaster, internal or external power failure, and in general, any event beyond the control of Vintage Spirit Company preventing the proper execution of orders (such as, for example, a traffic ban imposed by public authorities).


14/ Duties and taxes / Customs


Regulations are set by the European Union.

» Shipment to an EU country (European Union)

For all shipments to the billing address :
  • If the recipient is subject to VAT in the country of destination: invoicing will be tax-exempt after verification of the identification number.
  • If the recipient is not subject to VAT: invoicing will include French VAT.
  • For all gift items paid for in France: Invoicing is inclusive of VAT.

» Shipping outside the European Union

Invoicing is tax and duty free.
Customs duties at destination and import restrictions: Any customs duties payable at destination are the responsibility of the recipient of your shipment.
These duties are not the responsibility of Vintage Spirit Company.
This contract is governed by French law, both in terms of form and content. It is therefore the buyer's responsibility to check whether the products ordered can be imported into the country of delivery.

15/ Litigations

The language of this contract is French. In the event that the customer is not a French resident, any disputes relating to the commercial relationship with Vintage Spirit Company will be subject to the exclusive jurisdiction of the French courts. These provisions do not exclude members outside mainland France from the application of the rules laid down in international conventions.

In the event of an unresolved amicable complaint, the Customer has the possibility, for any purchase made on the Site or in the BLACKS LEGEND stores, to have recourse free of charge to a consumer mediator, in accordance with articles L.612-1 to L.612-5 of the French Consumer Code, provided in particular that the request is not manifestly unfounded or abusive and that it is made to the mediator less than one year after the written complaint submitted to Vintage Spirit Company.

As Vintage Spirit Company is a member of the Fédération du e-commerce et de la Vente à distance (FEVAD), the customer may submit a request to the FEVAD Consumer Mediator:
